This Privacy Policy describes the information that, as part of the normal operation of our services, we collect from you and what may happen to that information. Although this policy may seem long, we have prepared a detailed policy because we believe you should know as much as possible about Eddie’s practices so that you can make informed decisions.

By accepting the Privacy Policy, you expressly consent to our use and disclosure of your personal information in accordance with this Privacy Policy. This Privacy Policy is effective on May 30, 2005.

1. A Special Note About Children.

Children (persons under the age of 18) are not eligible to use the Site unsupervised and we ask that children do not submit any personal information to us. If you are under the age of 18, you may only use this Site in conjunction with and under the supervision of a parent or legal guardian.

2. Information We Collect.

Our primary purpose in collecting personal information is to provide you with a safe, smooth, efficient, and customized experience. This allows us to provide services and features that most likely meet your needs, and to customize our service to make your experience safer and easier. We only collect personal information about you that we consider necessary for achieving this purpose.

In general, you can browse the Site without telling us who you are or revealing any personal information about yourself. Once you give us your personal information, you are not anonymous to us. If you choose to use our services, we may require you to provide contact and identity information, billing information, shipping information and other personal information as indicated on the forms throughout the Site. Where possible, we indicate which fields are required and which fields are optional. You always have the option to not provide information by choosing not to use a particular service or feature.

We use your financial information, including credit card information, to verify the accuracy of your name, address, and other information, as well as to bill you for your use of our services.

We automatically track certain information based upon your behavior on the Site. We use this information to do internal research on our users' demographics, interests, and behavior to better understand, protect and serve you and our community. This information may include the URL that you just came from (whether this URL is on the Site or not), which URL you next go to (whether this URL is on the Site or not), your computer browser information, and your IP address. We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users’ movements around the site and to gather demographic information about our user base as a whole.

We use data collection devices such as "cookies" on certain pages of the Site to help analyze our web page flow, measure promotional effectiveness, and promote trust and safety. "Cookies" are small files placed on your hard drive that assist us in providing our services. We offer certain features that are only available through the use of a "cookie". You are always free to decline our cookies if your browser permits, although in that case you may not be able to use certain features on the Site.

Orders. If you purchase a product from our Online Catalogue, we request certain personally identifiable information from you on our order form. You must provide contact information (such as name, email, billing address and shipping address) and financial information (such as credit card number, expiration date). We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you.

Customer Service. We will also communicate with you in response to your inquiries, to provide the services you request, and to manage your account. We will communicate with you by email or telephone, in accordance with your wishes. If you send us personal correspondence, such as emails or letters, we may collect such information into a file specific to you.

Surveys. We may provide you the opportunity to participate in surveys on our site. If you participate, we will request certain personally identifiable information from you. Participation in these surveys or contests is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and e-mail address). We may use a third party service provider to conduct these surveys; that company will be prohibited from using our users’ personally identifiable information for any other purpose.

Referrals. In the future, we may ask for you to tell a friend about our site and will ask you for your friend’s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the site. Eddie’s stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program.

Your friend may contact the Privacy Officer to request that we remove this information from our database.

Our Disclosure of Your Information.

As a matter of policy, we do not sell or rent any of your personal information to third parties for their marketing purposes without your explicit consent. However, the following describes some of the ways that your personal information may be disclosed in the normal scope of business to provide our services.

We aggregate personal information and disclose such information in a non-personally identifiable manner to advertisers and other third parties for their marketing and promotional purposes. However, in these situations, we do not disclose to these entities any information that could be used to identify you personally. Certain information, such as your name, email address, password, credit card number, and bank account number (required only to establish a credit account with Eddies), are not disclosed to these third parties in a personally identifiable manner without your explicit consent

Agents. In order to fulfill your orders, we use a variety of outside shipping companies (such as Canada Post, Canpar, courier services and others) and occassionally may ship to you directly from our suppliers. We also use credit card processing companies to bill you for goods and services. These companies do not retain, share, store or use personally identifiable information for any other purposes.

Service Providers. We may use third parties that we refer to as service providers to facilitate or outsource one or more aspects of the business, product and service operations that we provide to you (e.g., webdesign, web hosting and bill collection) and therefore we may provide some of your personal information directly to these service providers. These service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit their use of the information we provide them for any other purpose except to facilitate the specific outsourced Eddie’s related operation, unless you have explicitly agreed or given your prior permission to them for additional uses.

Legal Requests. We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on Eddie’s or our Web site.

Due to the existing regulatory environment, we cannot ensure that all of your private communications and other personal information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example, third parties may unlawfully intercept or access transmissions or private communications, or users may abuse or misuse your personal information that they collect from the Site. Therefore, although we use industry standard practices to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.

5. Accessing, Reviewing and Changing Your Personal Information.

Upon your request, we will correct, update, or delete your contact information, billing information, shipping information, and financial information from our active databases. To make this request, email the Privacy Officer. Such information will be deactivated as soon as reasonably possible based on your account activity and in accordance with applicable law.

We will retain in our files some personal information you have requested to remove to prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, and comply with legal requirements as is permitted by law. Therefore, you should not expect that all of your personal information will be completely removed from our databases in response to your requests. However, such personal information will only be available to Eddie’s personnel.

6. Other Information Collectors.

Except as otherwise expressly included in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties, different rules may apply to their use or disclosure of the information you disclose to them. Since Eddie’s does not control the privacy policies of third parties, you are subject to the privacy policies of that third party. We encourage you to ask questions before you disclose your personal information to others.

7. General

Security. Your information is stored on the servers of our web hosting company and is not used by them for any other purpose. They use procedural and technical safeguards to protect your personal information against loss or theft as well as unauthorized access and disclosure to protect your privacy, including encryption and "firewalls." However, "perfect security" does not exist on the Internet.

If you have any questions about security on our Web site, you can send email us at Privacy Officer.

Please be aware that we, Eddie’s, is not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our site and to read the privacy statements of each and every Web site that collects personally identifiable information. This privacy statement applies only to information collected by this Web site.

Business Transitions. In the event Eddie’s goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personally identifiable information will likely be among the assets transferred.

Changes to this Privacy Policy. If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.
